NYS Workers Compensation Board Urges World Trade Center Volunteer Fund Claimants To Apply For The Zadroga Act Fund

The NYS Workers' Compensation Board‘s Office of the Advocate for Injured Workers has been a major supporter for World Trade Center Volunteers in receiving compensation for their illnesses and injuries related to the events of 9/11.  All claimants receiving benefits under the WTC Volunteer Fund are being encouraged by the Workers' Compensation Board to apply for the 9/11 Victim Compensation Fund Under the James Zadroga Act.

 

The World Trade Center Volunteer Fund and the 9/11 Victim Compensation Fund (VCF) are two separate entities. The WTC Volunteer Fund was set up in 2002 by Congress to provide Workers' Compensation benefits for unpaid Volunteers who assisted in clean-up, recovery and rescue efforts during the event of 9/11 and the aftermath. Typically, unpaid Volunteers are not entitled to receive workers' compensation benefits but an exception to the law was made for 9/11 Volunteers only.

 

The James Zadroga Act was signed on January 2, 2011 by President Obama in order to provide medical care and compensation to individuals who have suffered illnesses, injuries and death as a direct result of the events of 9/11 and the aftermath including clean-up, recovery and rescue efforts.  The Zadroga Act paved way for the 9/11 Victim Compensation Fund of 2001 to be re-opened to new applicants.   Applying to the 9/11 Victim Compensation Fund will not forfeit any benefits provided by World Trade Center Volunteer Fund. All new applicants must register with the 9/11 Victim Compensation Fund no later than October 3, 2013.

 

The NYS Workers' Compensation Board also encourages claimants to participate in the World Trade Center Health Program which is another segment to the James Zadroga Act. If you are planning to apply to the VCF, it is a good idea to participate in the WTC Health Program, not only for the benefit of free health care for your 9/11 related illnesses, but because it is recognized by the 9/11 Victim Compensation Fund as an extremely valuable source of medical documentation when reviewing cases. The VCF holds the WTC Health Program in high regard because the doctors that participate in the World Trade Center Health program specialize in 9/11 related illnesses. This can be an advantage to your 9/11 Victim Compensation Fund case.

$27 Million in Possible Cuts to Zadroga Act Funds Due to Inaction in Congress

If Congressional leaders in Washington, D.C. don't resolve their budget differences by this Friday, the first responders, survivors, construction workers, municipal workers and volunteers covered by the 9/11 Zadroga Act could lose $27 million.

The original funding for the Zadroga 9/11 Act, including the World Trade Center Health Program and the 9/11 Victim Compensation Fund is already woefully inadequate without the additional insult of the sequestration cuts.  The sad part is that this was completely predictable - and avoidable -  if Congress would simply do their jobs. 

Let's hope that all the partisan gamesmanship on both sides of the aisle in Washington is put aside by Friday so that the heroes and survivors of 9/11 are not harmed once again.

The World Trade Center Health Program’s Long Island Clinical Center of Excellence will be sponsoring a series of free informational clinics in December 2012 and January 2013 for individuals seeking help in filing claims under the Zadroga Act 9/11 Victim Compensation Fund.

These compensation benefits are in addition to any medical benefits you will receive under the WTC Health Program.  The clinics will be conducted by experienced VCF attorneys who will explain the program, who is eligible, which medical conditions are covered (including cancer) and how financial awards are determined.

Zadroga 9/11 Act Cancer Certification Process Begins with WTC Health Program

Current members of the World Trade Center Health Program  should have recently received a letter asking them to contact their Health Program Case Manager or their Clinical Center of Excellence (CCE) to begin the process of certifying their cancer(s) for treatment under the WTC Health Program.

The message from the WTC Health Program is clear:  If you were a 9/11 first responder, worker or resident in the "crash site" area" and have any of the cancers now covered under the Zadroga Act, you should contact either your local Clinical Center of Excellence or the National Program now to begin the process of certifying your particular cancer for free treatment under the Zadroga 9/11 Act.

Zadroga 9/11 Act Lawyer Troy Rosasco Quoted in Long Island Newsday on New Cancer Rule

911-health.jpgCongratulations to Ridgley Ochs, Newsday's Health reporter, for her excellent article profiling 9/11 cancer victims and discussing the inclusion of over 50 cancers as covered conditions under the Zadtoga Act, including the World Trade Center Health program and the 9/11 Victim Compensation Fund.

Our client, Joe Vuoso, a court officer in lower Manhattan on 9/11, was profiled in the article:

For Joseph Vuoso, 68, of Mount Sinai, the ruling means he will be able to worry less about money and more about keeping himself alive. A court security officer at the Foley Square courthouse in 2011, Vuoso watched the towers fall and stayed at his post the rest of that week. The next year he was diagnosed with leukemia that has since become an aggressive lymphoma.

"We have heavy medical bills," he said. "I'm on seven different drugs and the co-pays are astronomical . . . I'm fighting to keep me here right now."

His attorney, Troy Rosasco of Ronkonkoma, who represents about 500 first responders, called having cancer covered "a godsend." But he, like others, said he is worried there won't be enough money.

"It sounds like a lot, but when you start calculating people with cancer who are now out of their careers, their lost wage claims can add up to millions," he said.

The cancers covered by the new Zadroga 9/11 Act rule  include:

1) Malignant neoplasms of the lip, tongue, salivary

gland, floor of mouth, gum and other mouth, tonsil,

oropharynx, hypopharynx, and other oral cavity and

pharynx

2) Malignant neoplasm of the nasopharynx

3) Malignant neoplasms of the nose, nasal cavity,

middle ear, and accessory sinuses

 4) Malignant neoplasm of the larynx

 5) Malignant neoplasm of the esophagus

 6) Malignant neoplasm of the stomach

 7) Malignant neoplasm of the colon and rectum

 8) Malignant neoplasm of the liver and intrahepatic

bile duct

 9) Malignant neoplasms of the retroperitoneum and

peritoneum, omentum, and mesentery

 10) Malignant neoplasms of the trachea; bronchus and

lung; heart, mediastinum and pleura; and other ldefined

9/11 Zadroga Cancer Coverage Finally Official

One the eve of the 11th anniversary of the World Trade Center attacks, the federal government has issued a final rule including nearly 50 cancers as covered conditions under the James Zadroga Health and Compensation Act of 2010.  The rule will become law 30 days after it is published in the Federal Register on 9/12/2012.

It could not come too soon for the many 9/11 first responders, construction workers and area residents who are living with cancer today as a result of the toxic exposures at Ground Zero.  Unfortunately, it is too late for those who have already died from to 9/11 related cancers.

Turley Hansen 9/11 Victim Compensation Fund client Joseph Vuoso was profiled in Newsday today in relation to the welcome news of the final cancer coverage ruling.   In addition, our Zadroga Act client James Bruisma, a former NYPD Detective with lymphoma, was interviewed on FIOS 1 today. 

Today's Zadroga Act cancer victory was the result of the hard work of many within the 9/11 community, including Congressional leaders, the Fealgood Foundation and dedicated 9/11 Zadroga Act attorneys who testified and lobbied for cancer inclusionOur next goal must be to make sure all those who are in dire need of medical care and compensation receive their benefits swiftly. 

Zadroga Act Cancer Ruling Puts 9/11 Victim Compensation Fund Payments on Hold

According to a report in the Downtown Express on 8/15/2012, 9/11 Victim Compensation Fund Special Master Sheila Birnbaum has suspended all financial awards from the Fund  until Dr. John Howard and the National Institute for Occupational Safety and Health (NIOSH) finalize the recent proposed rule adding close to 50 different cancers to the list of medical conditions covered under the Zadroga Act

This means that those who have been found eligible for the Fund, but have only covered respiratory or digestive conditions, will have to wait longer for any award if their application was already submitted. 

The Special Master was quoted in the Downtown Express as follows:

“Our timetable has been put off — we’re waiting to see what the final rule is going to be on cancer,”said Birnbaum. “As soon as we find that out, I think we’re going to be in a position to start trying to make some payments, because then we’ll know what the estimates will be.”

However, Birnbaum stressed that her hands are tied with respect to the total sum available to claimants. “We only have the amount of money Congress provided to us,” she said. “The only way there’d be a change, I assume, would be a legislative change.”

Bottom Line - currently, the 9/11 Victim Compensation Fund (VCF) only has $2.775 billion dollars to split between all eligible victims.  Until the various cancers were recently proposed to be included in the list of covered conditions, the Fund (given its limited pot of money) could potentially have made larger awards to victims with solely respiratory or digestive conditions. 

However, if up to 50 cancers are added to the list of eligible conditions, it is likely that awards to the cancer victims will take up a large part of the overall Zadroga pie, making awards to non-cancer conditions potentially smaller.   

Of course, all of this depends on various contingencies including the number of overall applicants, the extent of their ilnesses and perhaps most importantly, whether Congress authorizes additional money toward the Fund.

Ms. Birnbaum correctly suspended awards from the Fund temporarily until the addition of any cancers is finalized.  If awards need to be proportionately reduced due to the limited Zadroga pot of money, she needs to first be certain whether the proposed cancers are eventually covered under the law.  This process could take take several months.

The good news is that the Fund and our law firm are as busy as ever processing applications for our clients.  The only thing that is on hold is the final award monetary determination.  "Eligibility Applications" and determinations are being processed daily. New rules regarding the evidence necessary to establish "proof of presence" at the "crash site" just came out earlier this week making it easier for certain workers to prove eligibility.  The hard work continues! 

 

News Alert: Zadroga 9/11 Health Act to Cover Multiple Cancers

The National Institute of Occupational Safety and Health (NIOSH) issued a Notice of Proposed Rule-making today which would include health care coverage for a wide variety of 9/11 WTC related cancers for health care coverage under the James Zadroga Act.

September 11th Victim Compensation Fund Cancer Ruling Expected this Week

According to a Zadroga Act article in yesterday's NY Times, Dr. John Howard, Director of the National Institute for Occupational Safety and Health (NIOSH), is expected to rule by late this week whether various cancers will be covered under the 9/11 Victim Compensation Fund (VCF).

Turley Hansen and Partners' attorney Troy Rosasco previously testified before Dr. Howard urging the inclusion of certain cancers for both medical treatment and compensation under the new James Zadroga Act.

However, 9/11 VCF Special Master Sheila Birnbaum correctly notes that inclusion of certain cancers could strain the resources of the Victim Compensation Fund, causing those victims whose respiratory illness's are already compensable to receive less compensation.

Unfortunately, given the limited pool of money currently in the Fund, this predicament pits one class of victims against others.  No matter how Dr. Howard rules, there will essentially be "winners" and losers" unless Congress decides to put more money into the Victim Fund.

The fair solution would be to include cancer but also include extra funding which would not decrease awards to respiratory and digestive victims who are already covered under the law.  So far, Congress has shown no inclination to revisit the issue of proper VCF funding. We will have to wait and see how Dr. Howard "splits the baby".

Which WTC Cancers Will be Covered by Zadroga 9/11 Victim Compensation Fund?

Now that the World Trade Center Health Program Scientific and Technical Advisory Committee has recommended that the 9/11 Victim Compensation Fund  should be expanded to include cancer, the next major question is which particular cancers should be covered? 

Our office has long advocated to Dr. John Howard, Director of NIOSH, for inclusion of cancer coverage under the the re-opened 9/11 Victim Compensation Fund as part of the Zadroga Act.   We currently represent over 40 clients with different forms of cancer which their doctors believe are related to their exposure to toxins at Ground Zero or other impacted areas such as the morgue or Fresh Kill landfill.

So which types of cancer should be covered under the WTC Health Program and the 9/11 Victim Compensation Fund?  While we believe that every individual exposed to WTC toxins should be allowed to make their own medical case for inclusion of their particular cancer.  However, practically, we know that the World Trade Health Center Program will likely only cover certain types of cancer

At a minimum, Turley, Hansen and Partners believe  that the following types of cancer should be included in the World Trade Center Health Program and that claimants with such cancers should be allowed to apply for compensation through the 9/11 Victim Compensation Fund:

  • Blood Cancers, including Multiple Myeloma, Leukemia and Non-Hodgkins Lymphoma
  • Head, Neck and Throat cancer
  • Oral cancer, including Tongue Cancer and Nasopharyngeal Cancer
  • Thyroid Cancer
  • Esophageal Cancer (Cancer of the esophagus)
  • Lung Cancer, including Mesothelioma
  • Kidney Cancer
  • Bladder Cancer
  • Prostate Cancer
  • Colon Cancer
  • Melanoma (skin) Cancer 

Should 9/11 Responders Drop Pending Lawsuits by 1/2/2012 in Favor of Zadroga Act Federal Victim Compensation Benefits?

To use an analogy, are you a "conservative investor" or do you like to take more risk? Or said another way, are you willing to gamble with litigation and pay your lawyers 25 or 33 1/3 % of a potentially higher return, or would you rather receive a quicker determination from the 9/11 Victim Compensation Fund re-opened by the James Zadroga Act and pay your lawyers only 10% as capped by law?

As reported by the Associated Press on 12/25/2011, if you are one of the estimated 1600 responders who still have a pending 9/11 lawsuit (not one where you are simply waiting to receive full payment), you have a choice to make prior to January 2, 2012.   Therefore, you essentially have to make the decision now.

Under the Zadroga Act, in order to claim benefits under the 9/11 Victim Compensation Fund, anyone with a pending 9/11 related lawsuit must withdraw from such lawsuit by January 2, 2012. The details of what one has to do to withdraw from such a lawsuit are below:

2.13 If I participated or am currently participating in a lawsuit related to September 11th, can I participate in the VCF? (Updated: December 5, 2011)

Yes, if you withdraw from the lawsuit or settled the lawsuit as described below. Therefore, if you or any dependent, spouse or beneficiary has filed a lawsuit or have been a party to a lawsuit in any Federal or State court relating to or arising out of damages sustained as a result of the terrorist-related aircraft crashes of September 11, 2001 or for damages arising from or related to debris removal (other than a lawsuit to recover collateral source obligations or a lawsuit against any person who is a knowing participant in any conspiracy to hijack or commit any terrorist act), you may be able to obtain compensation from the VCF if you meet the following conditions (and if you are otherwise eligible):

  • Pending actions: Individuals who have filed a lawsuit described above or who are a party to such a lawsuit may not file a claim with the Special Master unless they withdraw from such lawsuit on or before January 2, 2012. You must submit proof of timely withdrawal with your claim. For purposes of the Eligibility Form, you may submit either a court order establishing that the action has been discontinued and/or dismissed dated on or before January 2, 2012 or a notice/letter of withdrawal filed on the ECF system in the relevant docket on or before January 2, 2012. For purposes of receiving compensation, you must submit the final order of the court confirming the withdrawal or dismissal or all claims. That order may be dated after January 2, 2012 only if you have provided proof that you filed a notice of withdrawal on the ECF system in the relevant docket on or before January 2, 2012.
  • Settled actions: In the case of an individual who settled a lawsuit described above, such individual may not submit a claim with the VCF unless the lawsuit was commenced after December 22, 2003 and a release of all claims in such lawsuit was tendered by the individual, or by the individual’s attorney (provided the attorney has authority to tender the release) prior to January 2, 2011. You must submit proof documenting the date of commencement and release of all claims with your claim. If an attorney signed and submitted the release on behalf of the individual or the individual’s dependent, spouse or beneficiary, a copy of the retainer agreement with the attorney in the settled lawsuit must be submitted as proof that the attorney was authorized to sign the release.

If you have participated or are currently participating in such a lawsuit, you must certify on your claim form that the above conditions are satisfied.

So, should you withdraw?  Bottom Line - every individual must make the decision based upon the facts of their own case, unbiased competent legal advice and their own tolerance for risk. Clearly, the litigation route is riskier because lawyers will have to prove "fault" by the defendants, while the 9/11 Victim Compensation Fund is a safer because you only have to prove damages.  However, the litigation route could lead to a greater recovery, even after you pay the higher percentage attorneys' fees.

Can you get unbiased advice from an attorney who stands to gain more fees in litigation? I am not so sure.  Read the letter here from the law firm of Worby, Groner Edelman & Napoli Bern, LLP dated 12/21/2011 which was sent to one of my clients  and followed up with a phone call, urging him to reconsider his previous decision to apply for the federal Zadroga Act 9/11 Victim Compensation Fund. You be the judge. In my opinion, these types of letters almost demand an second legal opinion.

When I pointed out to my client that the letter from Worby Groner itself was factually wrong - he has been receiving Social Security Disability benefits for some time -  my client decided to stay with the safer and potentially more generous 9/11 Victim Compensation Fund.  

As John Feal urges in the attached letter, be careful out there and make the right decision in based upon the facts after advice from an attorney you trust. 

If you do choose to withdraw from your pending lawsuit in favor of Zadroga Act benefits, I suggest you send your current litigation lawyer a letter by FedEx tomorrow stating that you wish to "withdraw from any and all pending 9/11 lawsuits" and asking them to "take all actions to preserve my right to file a Zadroga claim".  Unfortunately, you really need to do it now!  Good luck!

Zadroga Act September 11th Victim Compensation Fund Releases Final Compensation Claim Forms, 12/ 5/ 2011

Yesterday, September 11th Victim Compensation Fund (VCF) Special Master Sheila Birnbaum released the final forms necessary for any claimant to fully file a Zadroga Act Victim Compensation Fund Claim. The official 21 page instruction form for personal injury claimants and/or their attorneys to file for "compensation" from the 9/11 Victim Compensation Fund can be downloaded here for your use

Whether or not you are currently represented by counsel, any eligible claimant can officially file 9/11 VCF claims as of today.  Please make sure to review the "9/11 Victim Compensation Fund Document Checklist" before filing, which can be downloaded here also. While the VCF is strongly encouraging online filing, you may also file your claim through the mail.

There is now light at the end of the tunnel for claimants who are sick because of their rescue, recovery and cleanup work in the Ground Zero "crash site" area. We expect that the Special Master will be making award determinations throughout 2012. It should be noted that claimants need not rush, and have until October 13, 2013 to file a claim. However, it is expected that those who are currently in dire financial circumstances (like many of our clients) will be filing their September 11th Victim Compensation Claims as soon as possible.

September 11th Victim Compensation Fund (VCF) Special Master Sheila Birnbaum officially reopened the Fund today for new claims.  Prior to today, claimants could only "register" for the 9/11 Victim Compensation Fund, which was not the same as filing for "eligibility" or "compensation" under the Fund.  Now, a claimant can file online to see if they are "eligible" for possible compensation under the September 11th Victim Compensation Fund.  Actual VCF "compensation claim" forms will still not be available until the end of November.  Click here for a down-loadable PDF Instruction Sheet for filing 9/11 Victim Compensation Fund "Eligibility" claims.

Zadroga Act 9/11 Victim Compensation Fund Opens October 3rd for Registration Only

The new Zadroga Act 9/11 Victim Compensation Fund officially opened for business today for "registration" only. However, no one can file a claim for compensation yet because the actual "Compensation Claim" forms will not be ready until the end of November at the earliest.

In a surprise move, VCF Special Master Sheila Birnbaum has established a three step "phased in" application process starting today. The 3 steps are as follows:

  1. Attorneys (or claimants without representation) can immediately "register" for the 9/11 Victim Compensation Fund here.  This registration process includes basic claimant information (including if they are represented by an attorney), the status of the claimant and information regarding "presence at the crash site";
  2. A new 9/11 VCF "Eligibility Form" will be released to the public on or about 10/28/2011. This eligibility form will ask questions about the nature of your injuries, why you were at the WTC site, whether you participated in the WTC Health Program and whether you participated in any prior 9/11 related lawsuits;
  3. On or about November 28, 2011, the Special Master will finally release the actual "Compensation Claim Form", which will ask questions on medical expenses, out-of-pocket costs, loss of earnings, loss of replacement services (did you need to hire a cleaner or a landscaper?), burial expenses when applicable and possible collateral source offsets that may decrease your award.

Eligible claimants will be able to see a new "9/11 Victim Compensation Fund Document Checklist" so they or their representatives can start assembling all necessary documents to perfect the claim.  Finally, the Department of Justice and Special Master Birnbaum have launched a new Zadroga 9/11 VCF Website  for the future dissemination of information.

This is the beginning of the process for our clients and and many others. I was asked in a television interview today how long the process would take from application to receipt of at least partial compensation awards? This will be affected by the number of applicants and the amount of Justice Department staff dedicated to the Fund. That being said, I predict that once an application  is deemed "substantially complete" by the Special Master, an initial decision on compensation should take between 3-6 months.

We will all need patience as we carefully navigate the procedures of the new fund. However, Ms. Birnbaum has made a good start with the "open and transparent" process she has promised from the beginning.

Will Zadroga 9/11 Victim Compensation Fund Application Forms be Ready on October 3rd?

The 9/11 Victim Compensation Fund Final Rules  state that the Fund will be "open" to receive claims next Monday, October 3, 2011.  However, to date, the all important 9/11 VCF application forms and claim filing instructions have not been posted on the Department of Justice website. As a result, the reality will be that few if any claims will be "filed" by claimants starting next Monday. 

This is fine to the extent that Special Master Sheila Birnbaum and her staff are perfecting the claim forms, which must strike the delicate balance between being simple enough for non-represented claimant's to complete, yet comprehensive enough so that claimants file for all the damages to which they are entitledThis is not an easy job.

I predict that the forms, along with comprehensive instructions and examples, will be released on Monday, October 3rd, and posted on the Justice Department VCF website here.   Zadroga attorneys  will then have a chance to digest the forms and begin the process of assembling all the information necessary for their clients to receive both the "economic damages" and "non-economic damages" they deserve.

New FDNY Scientific Study in the Lancet Medical Journal Links Cancer to 9/11 Ground Zero Toxic Exposure

According to an exclusive article in today's New York Post, a new scientific study linking 9/11 toxic exposure at Ground Zero among NYC firefighters and certain types of cancers  will be published next month in the prestigious peer-reviewed medical journal, The Lancet.

This will hopefully be the concrete scientific evidence that Zadroga 9/11 Victim Compensation Fund Special Master Sheila Birnbaum needs to allow first responders with certain cancers to file for compensation under the new Zadroga 9 11 Act.

The seven year federally funded study published in the The Lancet (which is world renowned and has been continually published since 1823)  is expected to contradict the prior determination of Dr. John Howard, Director of NIOSH, who previously found that there was not enough evidence to link certain cancers to Ground Zero toxic exposures.

9/11 Victim Compensation Fund Special Master Sheila Birnbaum has repeatedly stated that she will review the eligibility criteria for first responders with 9/11 related cancers based upon new scientific evidence linking exposure to certain cancers.  This study appears to be the missing link.

Zadroga 9 11 Act Victim Compensation Fund Final Rules Published - "Crash Site" Expanded to Below Canal Street to Include Chinatown

Zadroga Act Special Master Sheila Birnbaum today issued the long awaited Zadroga Act 911 Victim Compenstion Fund Final Rules & Comments.  See the Zadroga Act Final Rule Press Release here.

Perhaps the most important change  which resulted from the numerous comments to the draft rules was the expansion of the "crash site" to the area below Canal Street in lower Manhattan (including a good portion of Chinatown).  Previously, the "crash site" in lower Mahattan was limited to the area below Reade Street.  This will now allow Chinatown residents and others between these two streets to file claims.

Unfortunately, the Special Master is still excluding both cancer and PTSD from compensation coverage. Due to the language of the Zadroga Act itself, it is unlikely that claimants with PTSD, one of the most common and devastating illnesses to arise from 9/11, will ever be eligible for compensation (although they are eligible for medical care under the Zadroga Act).

At least the Special Master left the door open for the future inclusion of Zadroga 9 11 claimants with cancer pending further scientific study. At this time, I am of the opinion that their is still a 50% chance that cancer will be eventually be covered under the Zadroga Act Victim Compensation Fund.  We will continue to fight publicly for the inclusion of cancer under the Zadroga Act and we will continue to retain such cases in our office because we feel so strongly that cancer must be covered.

Zadroga Act Lawyer Hansen Appears on CNN and FOX News to Discuss Cancer Insult

Daniel J. Hansen of Turley Hansen & Partners  appeared last week on CNN and Fox News to criticize the decision of Dr. John Howard of NIOSH to exclude cancer  from the conditions covered for both treatment and compensation under the Zadroga 9/11 Act.

The failure of the federal government to currently include certain cancers for Zadroga 9/11 Act health benefits and compensation is an national disgrace.

This decision by Dr. Howard is particularly puzzling because many of the expert medical doctors working in his own World Trade Center Treatment Program have written reports for their WTC victims stating that their cancers are related to Ground Zero toxic exposure.

There are new scientific studies pending which may solve the problem of cancer coverage in the future. If they do not, there is no doubt in our minds that we can, and will, solve the cancer coverage problem in the halls of Congress. We have not yet begun to fight...!

What is the new VCF?

On January 2, 2011, President Obama signed the Zadroga Act, which reopens the September 11th Victim Compensation Fundof 2001.  The Zadroga Act expanded the scope of the original VCF to enable more individuals who suffered physical injury or death as a result of the September 11th attacks to obtain compensation from the program.  Like the initial VCF, the Act provides that an individual who elects compensation from the VCF waives his or her rights to pursue litigation to seek damages for the physical injury or death resulting from the September 11th attacks. 

The new VCF will be administered  by Special Master Sheila Birnbaum, who has been appointed by the Attorney General of the United States. 

The VCF will accept claims for five years  and will complete the payment of claims during 2016-17.  It is important that you understand the filing rules, because you must submit your claim within two years of the date you know of the physical injury or death resulting  from the attacks (or, if you already know of the physical injury or death in question, within two years of the date that the regulations are finally updated). 

Congress has appropriated a fixed sum of money for the VCF.  This fixed sum is $2.775 billion.  Congress has also determined that $875 million of that total amount may be paid out in the first five years of the VCF program.  The remainder may be paid in the sixth year. 

The limitations on funding for the VCF means that in the first five years of the program, claimants will receive only a portion of the compensation allowed under the rules of the VCF.  Depending on the number and type of claims, and in order to ensure that all eligible claimants receive an award, the Zadroga Act’s cap on funding means that it is possible that claimants’ awards will be pro-rated.

Who will be eligible for the new VCF?

The Zadroga Act provides that individuals present at the September 11th crash sites at the time of the crashes or between September 11, 2001 and May 30, 2002, and who suffered physical harm as a direct result of the crashes or debris removal, and the personal representatives of those who were present at the crash sites at the time of the crashes or in the immediate aftermath and who died as a direct result of the crashes, are eligible. 

The VCF’s draft regulations, which you may comment on at www.regulations.gov, define eligible physical harm to mean a physical injury to the body that was treated by a medical professional within a reasonable time from the date of discovering the harm.  In addition, the physical injury must be verified by or at the direction of the medical professional who provided contemporaneous medical care.

In order to be covered by the VCF, your physical condition must have been a result of September 11th.  To help make these determinations, the Special Master will identify conditions that are presumptively covered by the VCF.  The draft regulations provide that initially, the presumptively covered conditions will consist of physical injuries that are determined to be World Trade Center (WTC)-related health conditions by the WTC Health Program that is operated by the National Institute for Occupational Safety and Health and provides medical treatment and monitoring for WTC-related health conditions. 

Initially, those  presumptively covered conditions include the following: 

Aerodigestive Disorders

  • Interstitial lung disease
  • Chronic Respiratory Disorder – fumes / vapors
  • Asthma
  • Reactive Airways Dysfunction Syndrome (RADS)
  • WTC-exacerbated Chronic Obstructive Pulmonary Disease (COPD)
  • Chronic cough syndrome
  • Upper airway hyperreactivity
  • Chronic rhinosinusitis
  • Chronic nasopharyngitis
  • Chronic laryngitis
  • Gastro-Esophageal Reflux Disorder (GERD)
  • Sleep apnea exacerbated by or related to the above conditions. 

Musculoskeletal Disorders

  • Low back pain
  • Carpal tunnel syndrome (CTS)
  • Certain other musculoskeletal disorders for WTC responders who received treatment for a WTC-related musculoskeletal disorder that meets certain criteria.

Claimants who have a presumptively covered condition that was caused as a result of September 11th and are otherwise eligible may receive compensation from the VCF for certain losses.

When will the VCF open for claims?

The VCF is currently taking public comment on the draft rules that it published in June, meeting with those affected by the program, designing claims forms, and building the infrastructure that is necessary for a claims process.  After all of the comments on the VCF’s draft rules have been received, and the Special Master has considered how those comments should affect the program, the VCF will publish its final rules this Fall and begin receiving claims shortly thereafter.

Does it cost anything to file a claim?

No.

How long will claimants have to submit their claims?

In general, claimants will have two years to submit a claim.  The Zadroga Act provides that a person who knows of physical harm resulting from the September 11th attacks as of the date the regulations are published must file within two years of  the date of the regulations.  A person who subsequently learns of physical harm must file the claim within two years of the date you learn or should reasonably have known that you suffered a physical injury as a result of the attacks.

The Zadroga Act authorizes the VCF to receive claims for five years after it opens in 2011.  Final payments will be made in 2016-17. 

How are VCF awards and administrative costs funded?

The VCF is a government program, funded by taxpayers.  Congress appropriated $2.775 billion for the VCF, to cover both awards made to claimants and administrative costs.  Because every dollar spent on administrative costs is a dollar that cannot be paid to claimants, the VCF must provide a streamlined, efficient administrative process.

How long will the World Trade Center Health Program last?

Congress has funded the health program for at least the next five years, through 2016.

Eligibility

What are the eligibility requirements for participation in the new VCF?  Are the eligibility requirements the same as during the VCF’s first iteration, or have they changed?

The Zadroga Act changed the eligibility requirements to authorize claims from persons who were present at the crash sites between September 11, 2001 and May 30, 2002.  In addition, the Act changed the eligibility criteria to include claims from persons who suffered physical harm or death as a result of the crashes or as a result of debris

The Zadroga Act and the proposed rules state that to be eligible, a claimant must have been present at a “9/11 crash site” on September 11th or during its immediate aftermath.  What are the crash sites?

Under the Zadroga Act, the crash sites include the World Trade Center site, the Pentagon site, the Shanksville site, debris removal routes such as barges and Fresh Kills, and any area that is sufficiently close to the crashes that the Special Master determines to have had a demonstrable risk of physical harm.

Although the rules for the VCF are not yet final, the VCF’s draft rules, which are available at www.justice.gov/vcf, propose that this area should include the area in Manhattan south of the line that runs along Reade Street from the Hudson River to the intersection of Reade Street and Centre Street, south on Centre Street to the Brooklyn Bridge, and along the Brooklyn Bride.

I was not present at a 9/11 crash site, as those areas are defined in the proposed rules, but I believe my health condition was caused by September 11th.  Will I be eligible for the fund?

You may still be eligible.  Although the rules for the VCF are not yet final, the VCF’s draft rules, which are available at www.justice.gov/vcf, propose that the Special Master may find that there were other areas in which there was a demonstrable risk of physical harm resulting from the impact of the aircraft or any subsequent fire, explosions, or building collapses. 

In addition, please note that the proposed rules are not final. You may submit comments on this or any other provisions of the proposed rule at www.regulations.gov.  You may find instructions on how to do so at www.justice.gov/vcf.

If I applied to the VCF during its first iteration and my claim was denied, can I apply again now?

Although the rules for the VCF are not yet final, the VCF’s draft rules, which are available at www.justice.gov/vcf, propose that individuals who submitted claims in the VCF’s first iteration may amend and re submit their claims in certain circumstances:

  • The individual suffered a new injury that is eligible under the new VCF;
  • The individual’s prior eligible condition has substantially worsened, resulting in damages or loss that was not previously compensated;
  • The individual was not previously eligible for the VCF, but is now eligible as a result of changes contained in the Zadroga Act;
  • The individual’s previous claim was based on a condition that was not previously covered by the VCF, but that is now covered.

If I applied to the VCF during its first iteration and my claim was granted, can I apply again now?

  • The individual suffered a new eligible  injury;
  • The individual’s eligible condition has substantially worsened, resulting in damages or loss that was not previously compensated;
  • The individual was not previously eligible for the VCF, but is now eligible as a result of changes contained in the Zadroga Act;
  • The individual’s previous claim was based on a condition that was not previously covered by the VCF, but that is now covered.

If I did not experience any physical injury or death as a result of September 11th, but I experienced emotional or mental harms as a result of the events, am I eligible for the VCF?

No.  When Congress first created the VCF in 2001, it directed that only claimants who have a “physical injury” can be eligible for the VCF, and Special Master Ken Feinberg interpreted that phrase to mean “a physical injury to the body,” thus excluding claims for psychological conditions. 

In the Zadroga Act, Congress did not change how the VCF treats psychological conditions.  As a result, the VCF is not able to accept claims solely for psychological conditions.

The World Trade Center (WTC) Health Program does provide options for treatment of psychological conditions.  For information about whether you may be eligible for treatment for emotional or mental harms by the WTC Health Program, you may contact them by phone at 1-888-WTCHP4U (888-982-4748), or on the web at http://www.cdc.gov/niosh/wtc.

Do I have to live in New York to participate in the VCF?

No.  You do not have to live in New York to participate in the VCF. 

If I do not live in New York, how can I participate in the VCF?

Claimants will be able to submit information to the VCF through the mail or over the internet.  If a claimant would like a hearing to appeal his or her award, the VCF will make every effort to accommodate long-distance hearings through video-conference or, where necessary telephone conferences.

If I was not a uniformed responder, am I eligible for the VCF?

You do not have to be a uniformed responder to be eligible. Under the Zadroga Act, to receive a payment from the VCF, an individual must have been present at a September 11th crash site between the time of the crashes and May 30, 2002, and have suffered physical harm or death as a result of the September 11th air crashes or debris removal.

Are foreign nationals eligible for the VCF?

Yes.  The Zadroga Act permits both U.S. citizens and foreign nationals who satisfy the VCF’s eligibility criteria to participate in the VCF.

The Process / Determination of Awards

What kind of medical exam will be required for the VCF?

The rules for the VCF are not yet final.  In some cases, the VCF may be able to accept medical examinations provided under the World Trade Center Health Program.  It is possible that the type of medical exam required will vary depending on the claimant’s particular medical condition.  The VCF will publish more detailed guidelines in the future.

If I have not yet suffered economic harms, but fear that I may suffer economic harms in the future, should I submit a claim to the VCF now?

If you already know that you suffered physical harm as a result of September 11th, the Zadroga Act requires you to file with the VCF within two years of the date it opens.  This requirement applies whether or not you have suffered economic harm as a result of your condition. 

Although the rules for the VCF are not yet final, we expect that the VCF will consider future expected loss based on the claimant’s condition consistent with the methodology applied in the first VCF.    Similarly, individuals whose conditions substantially worsen after they submit their claim may be able to amend their claims.  The VCF’s draft rules, which are available at www.justice.gov/vcf , contemplate that an individual whose condition has substantially worsened, resulting in damages or loss that was not previously compensated, may amend his or her claim.  (If you would like to submit a comment on the draft rules, you may you may find instructions on how to do so atwww.justice.gov/vcf.)

If I have not yet suffered economic harms, but my condition is expected to worsen, am I eligible for the VCF?

If you already know that you suffered physical harm as a result of the September 11th attacks or subsequent debris removal, the Zadroga Act requires you to file with the VCF within two years of the date it opens.  This requirement applies whether or not you have suffered economic harm as a result of your condition.

If I am found eligible for the VCF, what treatments are covered?

The treatments that are covered for a particular claimant will depend on the nature and severity of the claimant’s condition.

 

Attorney-Client Issues

Do I need an attorney to participate in the VCF?

No, you are not required to have an attorney.  You are free to consult with attorneys and you should make your own decision as to whether you wish to engage an attorney.  Some attorneys have indicated a willingness to provide some assistance on a pro bono basis. 

If I choose to use an attorney, how will the attorney be paid?

The VCF will not reimburse claimants for fees charged by their attorneys.  Such fees must be paid by the claimant.  The Zadroga Act also provides a limitation on how much an attorney may charge in connection with the VCF.  Under the Zadroga Act, attorneys may not charge any claimant more than 10% of the payment the claimant receives as a VCF award. 

Attorneys who also charged their client a fee in connection with certain other September 11th-related litigation and settlement may only charge that client for representation before the VCF if the attorney’s total charge for both representations adds to 10% of the client’s total award in the other September 11th-related litigation.

If I was a plaintiff in another September 11th lawsuit, and my attorney signed a release before the bill was enacted and I opt in to that settlement, am I eligible for the VCF?

The rules for the VCF are not yet final.  The Zadroga Act states that if an individual tendered a release after the Zadroga Act was enacted on January 2, 2011, the individual is not eligible for the VCF.  The VCF will address the question of eligibility on a case-by-case basis.   If your attorney had authority to sign a release on your behalf and that release was signed and submitted to the defendant consistent with the terms of the settlement agreement between the claimant and the defendant prior to January 2, 2011, then the release will not bar the VCF claim. 

Where can I find out information about the settlements achieved in New York courts? 

The VCF cannot provide information about private settlements.  The VCF is a government program, established by Congress, and is separate from the lawsuits between individuals and the Port Authority, the Captive Insurer, and others.  Individuals with questions about the settlements should contact their lawyers.

Will settlements in civil suits regarding injuries related to September 11th affect my award in the VCF?

Yes.  The Act provides that the amount of the award shall be reduced by the amount of collateral source compensation that the claimant has received or is entitled to receive as a result of the crashes.  Therefore, settlement payments from law suits will be deducted from any award.

Legal Issues

Is my VCF award taxable?

The awards are not subject to Federal income tax.  In Revenue Ruling 2003-115, the Internal Revenue Service determined that periodic payments made to a claimant of the VCF pursuant to certain agreements are excluded from the gross income of the claimant.  Similarly, any payments to an estate or secondary beneficiary pursuant to such agreements are excluded from the gross income of the successor beneficiary.

Can my VCF award be seized in a bankruptcy proceeding?

How an award is handled in bankruptcy will depend on the facts and circumstances of each individual’s situation.  An attorney may be able to provide more information based on each individual’s particular case.

If I am eligible for the VCF, am I also eligible for veterans benefits?

The VCF is open to certain individuals who suffered personal injuries or death as a result of September 11th, regardless of whether they qualify as veterans.  Individuals with questions about their eligibility for veterans benefits should contact the Veterans Administration.  The Zadroga Act requires the Special Master to apply certain offsets to reduce the amount of compensation by the amount of collateral source compensation that the claimant has received or is entitled to receive as a result of the terrorist related aircraft crashes of September 11th.  Whether veterans benefits will be offset (so that the award is reduced) will depend on the specific benefit (i.e., what the benefit is for and whether it is subject to termination.)

Covered Conditions

General

If I received payment in the VCF’s first iteration, and I am suffering from a new condition that was not known or diagnosed at that time, am I eligible to submit a claim to the VCF now? 

Although the rules for the VCF are not yet final, the VCF’s draft rules, which are available at www.justice.gov/vcf, contemplate that an individual who has suffered a new eligible injury, or whose condition has substantially worsened, resulting in damages or loss that was not previously compensated, may amend his or her claim.  If you would like to submit a comment on the draft rules, you may find instructions on how to do so at www.justice.gov/vcf.

How will the VCF determine if a condition was a result of September 11th? 

The rules for the VCF are not yet final.  The VCF anticipates applying guidelines consistent with those adopted by the World Trade Center (WTC) Health Program.  The WTC Health Program relies on the best available science to determine whether a particular condition is related to September 11th and provides a protocol for doctors to determine whether a particular individual’s condition is a WTC-related health condition.

If I have a condition that was a result of September 11th but is not a common condition, am I eligible for the VCF? 

Yes.  Individuals who suffered injuries as a result of September 11th and who meet the other eligibility requirements may submit a claim, even if their condition is not common across the population. 

Although the rules for the VCF are not yet final, the VCF’s draft rules, which are available at www.justice.gov/vcf, propose that the VCF will post a list of conditions that have been determined to be related to September 11th.  Individuals with other conditions may also be eligible in extraordinary circumstances.  If you would like to submit a comment on the draft rules, you may find instructions on how to do so at www.justice.gov/vcf.

If I have suffered a physical injury as a result of September 11th but am still able to work, am I eligible for the VCF?

Yes.  Individuals who are still able to work may receive compensation for other economic losses they may have suffered, such as medical expenses or for non-economic losses.

I do not see my injury on the list of eligible injuries in the draft regulations.  How will I know if my injury is covered or might be covered in the future? 

In determining which conditions should be covered by the VCF, we intend to work closely with the World Trade Center (WTC) Health Program, which relies on the best available science to determine whether a particular condition is related to September 11th, and provides a protocol for doctors to determine whether a particular individual’s condition is a WTC-related health condition.

Will side effects from taking September 11th-related medications be covered by the VCF?

This may depend on the circumstances of your particular condition.  Although the rules for the VCF and the methodologies for determining awards are not yet final, the Zadroga Act provides for the VCF to base awards on the losses that each claimant has suffered as a direct result of September 11th.  Whether side effects arising out of medications taken to treat a covered condition are themselves directly related to September 11th will depend on the type of condition, the nature of the medication and the side effects, and other factors that may vary from individual to individual.

Cancer

Will cancer be covered by the VCF?

PTSD and Emotional Harm

Will Post-traumatic stress disorder (PTSD) or emotional injuries be covered by the VCF?

 The Zadroga Act provides that only claimants who have a “physical injury” can be eligible for the VCF.  The regulations implementing the original VCF  interpreted that phrase to mean “a physical injury to the body,” thus excluding PTSD. 

In the Zadroga Act, Congress did not change the language defining the eligible injuries and thus did not change the the treatment of PTSD. The Zadroga Act treats PTSD as a mental or psychological condition, not a physical condition.  As a result, the VCF is not able to accept claims for PTSD.

Multiple Conditions

If I have multiple conditions as a result of September 11th, will the VCF cover all of them?

As long as each condition was caused as a direct result of September 11th, the VCF will cover all of the conditions suffered by each eligible claimant.  However, the method for determining compensation will depend on proof of economic loss and a determination of non-economic loss.   The VCF will not provide multiple awards or awards for each condition. 

Funds and Awards

When will I receive my full award?

Under the proposed rules, once a claim is fully submitted and is determined to be substantially complete, the VCF will issue a determination on eligibility and, if appropriate, on compensation.  You will have the right to appeal the determination.  Once you have accepted the award or completed the appeal process, the VCF will issue a payment within 20 days of that date. 

These initial payments will not contain a claimant’s full award.  In order to ensure that there is enough money to make a payment to every claimant who is entitled to receive a payment, the Zadroga Act provides that the first payment to each claimant should contain a portion of the full award.  As a result, the size of that first payment will depend on the amount of the claimant’s full award, as well as the total number of claimants and the amount of money available.  The Zadroga Act provides that most of the available money will be distributed at the end of the program, so in most cases these initial payments will be significantly less than the full award.  Only $875 million will be available to pay claims in the VCF’s first five years.

The Act provides that the remainder of the award may be paid five years after the VCF opens.  Claimants can thus expect to receive the rest of their payment in 2016-17.  Depending on the number and type of claims, and in order to ensure that all eligible claimants receive an award, the Zadroga Act’s cap on funding means that it is possible that those payments will be pro-rated.

Because initial payments will reflect only a portion of the total payment that a claimant can expect to receive, the claimant may wish to consult with a financial planner regarding how to make best use of the payments as they are received.

Will there be a procedure for receiving early payments, or “advance benefits,” as they were known in the first VCF?

The Zadroga Act requires two rounds of payments:  an initial payment to each eligible claimant during the VCF’s first five years, after the claimant’s claim has been reviewed, followed by a second payment in the VCF’s sixth year.  Although the rules for the VCF are not yet final, VCF’s draft rules, which are available at www.justice.gov/vcf, propose to offer only these two payments, and not to add a third, early “advance” payment.  Adding a third round of payments will increase the VCF’s administrative costs, which will result in less money available for claimants.  Further, because the Zadroga Act already provides for two rounds of payments, a third round may be unnecessary.  (If you would like to submit a comment on the draft rules, you may find instructions on how to do so at www.justice.gov/vcf.)

What is economic loss? 

Economic loss is an estimate of the compensation that would have been available to the family if the tragedy had not occurred.  This includes, for example, loss of earnings, medical expense loss, or business opportunity losses.

What is non-economic loss? 

Non-economic losses include losses for physical and emotional pain or suffering, loss of enjoyment of life, mental anguish, and other non-pecuniary losses.

Will I be able to know approximately how much my award will be before I decide whether to submit a claim?

The proposed rules for computing economic loss are set forth in sections 104.41 through 104.47 of the proposed rules.  The VCF intends to provide guidance and illustrations to enable a claimant to evaluate his or her potential award before deciding to submit a claim.    That information will be posted on the VCF website, at www.justice.gov/vcf.

If my career is cut short as a result of a condition that is compensable under the VCF will my award take into account lost wages?

Yes.  The Zadroga Act provides for the VCF to take into account a claimant’s loss of earnings as a result of a physical injury caused by September 11th.

If my career is cut short as a result of a condition that is compensable under the VCF will my award take into account decreased pension benefits as a result of the shorter career?

Yes.  The Zadroga Act provides for the VCF to take into account a claimant’s loss of earnings and other benefits related to employment.

Will the amount of awards be the same as in the VCF’s first iteration, or will they be reduced?

The methodologies for computing economic loss will be based on those from the original VCF, with certain components of the economic loss computation updated.  The VCF will publish guidance on these computations.  The amount that each claimant will receive will depend on the amount of economic loss (if any), the non-economic loss, the offsets applied and the number of claimants and the aggregate amount of eligible awards.  In the Zadroga Act, Congress appropriated $2.775 billion to pay all of the awards, which means that the VCF cannot pay out any more than that amount.  This means that if the aggregate amount of awards and administrative costs exceeds this capped amount, the awards will have to be reduced.  The VCF cannot determine whether such a reduction will be necessary until it receives and evaluates all the claims. 

What is a collateral source?  How will the Special Master determine the amount of my collateral source benefits?

The Act defines collateral sources to mean all such sources, including life insurance, pension funds, death benefit programs and payments by Federal, State, or local governments related to the terrorist-related aircraft crashes of September 11, 2001 or debris removal, including under the World Trade Center Health Program and payments made pursuant to the settlement of a civil action for damages sustained as a result of the terrorist-related aircraft crashes of September 11, 2001 or debris removal. The Act and the draft regulations require the Special Master to reduce the total amount of compensation by the amount of the collateral source compensation the victim’s beneficiaries has received or is entitled to receive as a result of the terrorist-related aircraft crashes.

During the previous iteration of the Fund, Special Master exercised discretion in valuing the appropriate deductions for collateral offsets including by determining:

1. Whether the particular offsets fall within the definition of collateral sources;
2. Whether beneficiaries of the Fund are “entitled” to receive compensation from those collateral sources;
3. Whether the collateral source compensation is certain or can be computed with sufficient certainty to enable its deduction while ensuring that the beneficiaries receive the total compensation that is appropriate; and
4. The appropriate amount of the compensation that should be deducted, taking into account the time value of money and contributions made before death by the victim in the nature of investment or savings.

Under the proposed rules, the Special Master would be permitted to exercise discretion in a similar fashion.

Are charitable gifts offset? Will a benefit from a charity managed by a government agency be considered as a collateral offset?

The proposed rules adopt the approach taken previously, which is that benefits from charities disbursing private donations will not be treated as collateral source compensation, even if such charities were created or managed by government entities.

Victim Compensation Fund Special Master Sheila Birnbaum Wins Hearts and Minds of 9/11 Victims at Town Hall Meeting

Even the most skeptical New Yorker would have had a hard time not being impressed by Zadroga Act Special Master Sheila Birnbaum at a Town Hall Meeting  sponsored by the FealGood Foundation in New York City last week.  She had just the right touch for an assembled audience of 9/11 victims with serious and/or disabling health problems.

As a life-time New Yorker from the Bronx, she immediately connected with the over-flowing crowd. In a very straight forward manner she described her role as Special Master of the Fund and the potential limitations of the new Zadroga Act (more claimants than the first Victim Compensation Fund (VCF) and less money this time around).   In addition, only $875 million can be distributed to claimants in the first five years of the Fund, with the remaining almost $2 billion to be distributed in the sixth year. Therefore, all individual financial awards are likely to be split into two "chunks", with the largest chunk coming in the sixth year.

Finally, Ms. Birnbaum directly addressed the difficult issue of whether there was enough total money ($2.8 billion) in the 9/11 Victim Compensation Fund to fully compensate all claimants at similar levels as the first Victim Compensation Fund.  It seems that she does not believe there is enough money at this time and that full awards will need to be pro-rated (that's where fine organizations like the FealGood Foundation will come in to lobby Congress for any needed additional funds).

Ms. Birnbaum deftly handled all the audience questions. She looked claimants in the eye and did not over-promise.  She explained difficult concepts of damages in plain language, while always assuring the claimants that the process would be fair and transparent.  She was part therapist, part skilled litigator, part hometown hero and most of all - a friend and advocate for  victims.  No wonder her remarks were met with applause throughout the evening.  As I commented in my live Twitter Feed that evening, she "wowed" them.

We wish Ms. Birnbaum the best of luck in her challenging new assignment. From what we saw at the meeting last week, 9/11 victims have a true friend in Ms. Birnbaum.

Zadroga 9/11 Special Master Sheila Birnbaum Issues New Rules for Victim Compensation Fund Procedures

As reported in the Wall Street Journal  and Daily News  today, new Zadroga Act 9/11 Victim Compensation Fund Special Master Sheila Birnbaum has released updated draft regulations regarding Zadroga claims procedures.  The rules are subject to a 45 day comment period and can be changed depending on those comments. We will be studying the new proposed rules closely for any possible comments we may make regarding inclusion of certain cancers under the Zadroga 9/11 Act.

As we expected, the new rules limit compensation to those claims involving "physical harm". Claimants who have only psychological injuries will not be able to claim compensation from the 9/11 Victim Compensation Fund, although they are entitled to medical care. Claimant's with a combination of both physical and mental injuries will be able to claim compensation under the Act for the physical part of their injuries.

The new rules significantly expand the geographic boundaries for 9/11 VCF claimants who were injured to include all portions of Lower Manhattan south of the Brooklyn Bridge, Centre Street and Reade Street.  

The Special Master at this time is proposing to use the presumptive list of WTC related illnesses established by the World Trade Center Health Progam as the list that the Victim Compensation Fund will adhere to, except under rare extraordinary circumstances.  Therefore, the decisions of Dr. John Howard , Director of the World Trade Center Health Program, on which illnesses will be covered, including certain cancers, will guide the Special Master.

In a significant surprise, the new rules permit the “amendment” of prior Victim Compensation Fund claims made under the original Fund, which closed in December 2003. For example, a claimant who received compensation under the original Fund for “asthma”, but who since has since developed a new 9/11 related condition such as “interstitial lung disease”, can  now “amend” his old claim for additional compensation. Similarly, if the prior Victim Compensation Fund compensation recipient’s condition has “substantially worsened”, that claimant can now apply for additional compensation. Therefore, all claimants who collected for injuries from the prior VCF should consult a Zadroga Act attorney today to see if they are eligible for additional compensation. 

Finally, the Zadroga 9/11 Act  permits the Special Master to distribute only $875 million of the newly allocated $2.75 billion to the Fund in the first five years, leaving the remaining amount to be paid in the program’s 6th year. The Special Master will have to “pro-rate” or reduce the initial awards, which may upset some claimants. The bottom line is that all claimant's will receive their full award, but it will likely be in two parts years apart.

The British Broadcast Corporation (BBC),  a worldwide leader in television news reporting, visited our side of the pond last week to interview Turley Hansen Partner Troy Rosasco  at our office in The Woolworth Building in lower Manhattan for a documentary commemorating the 10th Anniversary of 9/11. 

Troy Rosasco answered questions about the new Zadroga 9/11 Act and re-opening of the 9/11 Victim Compensation Fund.  In addition, the BBC interviewed one of our clients about how his 9/11 related illnesses have changed his life over the last nearly 10 years. After leaving our office, they were off to interview Congressman Jerrold Nadler, Co-Sponsor of the Zadroga Act in the US House of Representatives.

The documentary special is being broadcast to coincide with the 10th Anniversary of 9/11, which is now less than 100 days away. In addition, it will be broadcast in podcast format on the BBC radio program "Crossing Continents". It was a pleasure working with Linda Sills and her entire BBC production team for this important documentary.

Zadroga Lawyer Troy Rosasco Testifies at Victims Compensation Fund Hearings

Zadroga Act lawyer Troy Rosasco  provided compelling testimony yesterday at the public hearings held by the National Institute for Occupational Safety and Public Health (NIOSH) to support the broad rights of 9/11 victims. 

In his testimony, Mr. Rosasco urged Federal Regulators, including a direct appeal to NIOSH Director John Howard, M.D., that the regulations for the 9/11 Victims Compensation Fund must include the victims who suffer from the various forms of cancer as a result of their exposure to the toxic dust and gasses released by the 9/11 attacks.

Mr. Rosasco supported his arguments to the regulators by pointing out the fact that other federal and state agencies, including the New York State Workers' Compensation Board, NYC Disability Pension System and implicitly the federal Social Security Administration, recognize the causal connection between the toxic 9/11 cloud and the host of cancers and other injuries that are being diagnosed is people who were exposed to the dust and debris.

Mr. Roasaso further urged Dr. Howard and the other Federal Regulators to include Post Traumatic Stress Disorder (PTSD) in the list of conditions that are covered by the Zadroga Act Victims' Compensation Fund

Mr. Rosasco's comments were met with applause by the countless 9/11 victims present at the hearings, and welcomed by Dr. Howard and the other Federal rule-makers.

As reported in the New York Post today, our partner ( and fellow Zadroga lawyer) Chet Lukaszewski, has won a groundbreaking 9/11 World Trade Center pension case for the widow of a NYC firefighter.

In the first World Trade Center Appellate disability pension decision in favor of a first responder, the Appellate Division, Second Department, held that the New York City Fire Department Pension Fund Medical Board had provided an inadequate rationale several times in recommending denial of a petition for benefits brought by the widow of Lt. Cruz A. Fernandez in Matter of Fernandez v. Board of Trustees of N.Y. Fire Dept. Pension Fund, Subchapter 2 (App. Case# 2009-06506; Index#26232/08).

The Appellate Division overturned the denial by the FDNY Pension Fund of a petition for line of duty death benefits brought under the "World Trade Center Law", which had been previously upheld by the lower Court, and remanded the application for further consideration.  The application was brought by the widow of an FDNY Lieutenant who had run 9 marathons during his career, and spent hundreds of hours at the World Trade Center site, and retired in good health in 2002.

But soon after he began to suffer various health issues, and eventually died in July 2006 as a result of a complex cardiac event while playing in shallow water with his young nephew in full view of his family while on vacation.  The widow's  multiple medical experts found the decedent to have died as a result of his toxic 9/11 exposures, as evidenced by coal dust found throughout his body during an autopsy,  including his lungs, and other scientific indicators that demonstrated that his body, particularly his heart, had been weakened by the toxins, which lead to the cardiac event that caused his death.

The Pension Fund Medical Board found the death to simply be a drowning, which was adopted by the Fund’s Board of Trustees; and in Court the Pension Fund argued that even if the petitioner was caused to drown by a cardiac event, it was a standard heart attack, with no WTC exposure connection.  The widow argued the black coal dust in the decedent’s body and lungs, known as anthracosis (coal miners’ disease), which was the primary factor in his death, was both a “disease of the lower respiratory tract” as well as “heavy metal poisoning”, which are both “qualifying conditions” under the under the WTC Law, and thus the death was WTC related.  

The Court held in reversing the lower Court and the Fund: "Although the Board of Trustees [of the pension fund] is entitled to rely on the report and recommendation of the Medical Board, the proceedings should disclose the reason for the denial, and the determination must be set forth in such manner as to permit adequate judicial review… Under the circumstances of this case, the explanation by the Medical Board was insufficient." The Court ordered that the Pension Fund Trustees to send the case back to its Medical Board to specifically address medical evidence indicating that Mr. Fernandez's drowning was precipitated by his heart condition, which was the result of respiratory distress caused by responding to the 9/11 attacks.

This widow was lucky to have our partner (and fellow Zadroga 9/11 attorney) Chet Lukaszewski as her disability pension lawyer.  Now lets hope the Medical Board finally does the 'right thing'.

Zadroga Act Lawyer for a Second Opinion on 9/11 Lawsuit Settlement

If I have a 9/11-related lawsuit that is NOT settled, can  I file a non-lawsuit administrative claim under the Zadroga Act?

The answer is NO! 

The Zadroga Act states, to be eligible for compensation under the 9/11 Victims Compensation Fund, an injured claimant who is part of a lawsuit that has not yet fully settled, MUST withdraw from any lawsuit. While this provision does not affect those who have already settled 9/11 lawsuits and paid legal fees ranging from 25% to 33 1/3 % to their old lawyers, many claimants in related 9/11 litigation may not have settled their 9/11 lawsuits to date. These injured victims and first responders should not feel pressure to settle their lawsuits now! It may hurt them financially to do so now.

In particular, the Zadroga Act  states that:

an individual may NOT submit a claim for Victims Compensation unless such individual withdraws from such action within 90 days from the date on which Zadroga regulations are issued (the regulations are expected soon).   A lawsuit settled after January 2, 2011 (the date that the Zadroga Act was signed into law), disqualifies the injured person from any right to file a claim for Victims Compensation. 

Should I call a new Zadroga Act Lawyer for a Second Opinion?  

A claimant may want to get a second opinion from a different Zadroga Act lawyer since, as reported in the Daily News, some:

 " lawyers do better with the lawsuits, where they earn 25%, instead of a maximum of 10% under the Zadroga law."  

A second opinion from a new, unbiased Zadroga Act lawyer guarantees that any possible conflict of interest that the lawsuit lawyer may have in recommending that an injured person continue with a lawsuit -where the lawyer's fee is 25% (or even more) - rather than file a Zadroga Act claim where the lawyer's fee is much less (at most 10%, sometimes less).

A second opinion from an  new Zadroga Act lawyer  avoids the potential "mixed signals" given to the 9/11 victims from the 9/11 lawsuit lawyers.  Visit us in our offices in the historic Woolworth Building in lower Manhattan or one of our other convenient locations. You may pay lower legal fees!

Zadroga 9/11 Victims Compensation Fund Covers Ground Zero Sanitation Workers, Cleaners, Porters & Window Washers

Last week, we reported that utility workers working near Ground Zero are covered by the recently reopened 9/11 Victims Compensation Fund in the Zadroga Act, giving these workers the right to file a claim for compensation for 9/11-related conditions and injuries.  The Zadroga Act, which reopened the Victims Compensation Fund (VCF), has opened the fund to a wide variety of 9/11 first responders and clean-up workers.

The Zadroga 9/11 Health and Compensation Act  has vastly expanded the definition of who is able to file a claim from the original law (covering first responders and survivors only), to those workers and volunteers who assisted, in any way, in the clean-up efforts.  

The new Zadroga Act, which reopens the Victim Compensation Fund (VCF) of 2001, defines this large class of workers and volunteers eligible for monetary compensation to include:  

1. Sanitation workers

2. Window washers near Ground Zero

3. Commercial cleaners in the building or areas surrounding Ground Zero. 

4. Porters, janitors, and others who cleaned the toxic dust and debris and fallout from Ground Zero. 

5. City workers and private carting and sanitation workers who removed the debris and refuge from the 9/11 sites, including along route to any dump or landfill.

6. Barge and other maritime workers (dockworkers, captains, and others) who helped move the debris from Ground Zero and the surrounding areas. 

7. Truck drivers and their helpers who transported or handled the debris and materials from the World Trade Center or the nearby areas

8. Transfer station workers who handled or helped move debris and materials from the 9/11 sites

Zadroga 9/11 Act Questions and Answers from Congresswoman Carolyn Maloney

Congresswoman Carolyn Maloney, and her top-flight office staff, provided a wealth of helpful information today on the Zadroga Act as interpreted by the reputable and unbiased Congressional Research Service (CRS).

Some teachers leave for home at the end of the last period of the day. Some stay late to give extra help to their students. If Congresswoman Maloney were a teacher, she would be staying late to benefit her pupils. She is a real professional and is showing it once again, to the benefit of all 9/11 victims.  

What Diseases/Conditions are Covered by the Zadroga WTC Victim Fund?

The passage of the Zadroga 9/11 Act  left open a number of questions, including the critical question of what diseases or conditions are covered by the WTC Victim Fund.  While the Zadroga Act and the WTC Victims Fund does not list which diseases will be eligible for compensation and further clarification will need to come from the rules issued by the Justice Department and the Department of Health and Human Services (expected in the coming months), some guidance of conditions eligible for compensation under the WTC Victims Fund may be found in Part 1 of the Zadroga Act - which lists the illnesses and conditions eligible for medical care and monitoring. These conditions include:  

1. Interstitial lung diseases.

2. Chronic respiratory disorder--fumes/vapors.

3. Asthma.

4. Reactive airways dysfunction syndrome (RADS).

5. WTC-exacerbated chronic obstructive pulmonary disease (COPD).

6. Chronic cough syndrome.

7. Upper airway hyperreactivity.

8. Chronic rhinosinusitis.

9. Chronic nasopharyngitis.

10. Chronic laryngitis.

11. Gastroesophageal reflux disorder (GERD). 

We believe that a strong argument can be made that the Zadroga Act and the WTC Victims Fund should cover the conditions listed as examples AND all other conditions that may be reasonably related to the toxic dust fallout in the months following the attacks, including various cancers.   Compensation, of course, will require the claimant to vigorously pursue the medical proof and present a compelling claim to the WTC Victim Fund Special Master.  

 

Verizon, Con Ed, AT&T and Other Utility Workers Covered by 9/11 Zadroga Victim Compensation Fund

As first reported here earlier this month, the Zadroga 9/11 Act   opens the Victim Compensation Fund to a wide range of workers and volunteers who helped in the clean-up of the World Trade Center sites who were present beyond just the date of the attacks , unlike the original Victims Compensation Fund. This includes utility workers.

One of our first 9/11 clients was a young New Jersey  telecommunications technician who worked for Sprint for months after the attack restoring service.  Unfortunately, due to his exposures at Ground Zero, he was diagnosed with, and later died from, interstitial lung disease.  Interstitial lung disease is often caused by exposure to dusts, including asbestos and silica.  Despite his family's tremendous loss, we were later able to obtain a substantial financial award for his widow and children.

Another one of our clients who worked for Verizon at the WTC site restoring service was later diagnosed with nasopharyngeal cancer (carcinoma). Thankfully, this young man's cancer is now in remission and he has since returned to work.  We are now working on his Victims' Compensation Fund claim.  Finally, one of our long-standing client's who was working for an electrical contractor was recently diagnosed with leukemia, a blood cancer too often seen among 9/11 rescue and repair workers, due in part to the high amount of the toxic chemical "benzene" found at Ground Zero. We are now preparing to file his claim with the Victim Compensation Fund.

As you can tell, one large category of workers and volunteers that were crucial to the cleanup efforts were the utility workers such as Con Ed, Verizon, AT&T, Sprint and other utility workers who worked in the WTC area in the 8 1/2 months after 9/11.  Also included in the new Victim Compensation Fund are the Verizon workers who were in the Verizon offices at 140 West Street on the date of the attacks who suffered injures on 9/11 or have developed any 9/11-related illnesses since that time. 

Most importantly, the Zadroga 9/11 Act vastly expanded the Victims Compensation Fund by not limiting claimants to the area around the World Trade Center site itself, but expanding it to the surrounding buildings and lower Manhattan neighborhoods.  In particular, the Victim Compensation Fund was expanded to include workers at:

  • the World Trade Center site,
  • the buildings or portions of buildings that were destroyed as a result of the terrorist-related aircraft,
  • any area contiguous to a site of such crashes that the Special Master determines was sufficiently close to the site that there was a demonstrable risk of physical harm resulting from the impact of the aircraft or any subsequent fire, explosions, or building collapses (including the immediate area in which the impact occurred, fire occurred, portions of buildings fell, or debris fell upon and injured individuals), (such as dust, debris, etc.)and
  • any area related to, or along, routes of debris removal, such as barges and Fresh Kills. 

 

 

Nadler Says Manhattan Downtown Residents Eligible for Zadroga 9/11 Victims' Compensation Fund Awards

Are downtown Manhattan residents who were exposed to toxic dust as a result of the 9/11 attacks and clean up eligible for a Victims' Compensation Fund (VCF) Award under the new Zadroga 9/11 Act?

The answer is YES, according to Congressman Jerrold Nadler, Co-Author of the James Zadroga 9/11 Health and Compensation Act of 2010.

As reported in The Tribeca Trib, there was confusion regarding Zadroga 9/11 Act eligibility for downtown Manhattan residents.  Congressman Nadler, co-author of the Zadroga Act, issued a statement clearly stating that downtown residents, who were not first responders, were also eligible foe a monetary award under the Victim Compensation Fund.

In fact, the World Trade Center 9/11 Crash site, which in part determines eligibility for downtown residents by extending the "WTC Crash Site", has been expanded.  The new definition of the World Trade Center Crash Site has been expanded in the Zadroga 9/11 Act:

(14) 9/11 CRASH SITE- The term `9/11 crash site' means--

(A) the World Trade Center site, Pentagon site, and Shanksville, Pennsylvania site;

(B) the buildings or portions of buildings that were destroyed as a result of the terrorist-related aircraftcrashes of September 11, 2001;

(C) any area contiguous to a site of such crashes that the Special Master determines was sufficientlyclose to the site that there was a demonstrable risk of physical harm resulting from the impact of theaircraft or any subsequent fire, explosions, or building collapses (including the immediate area in which the impact occurred, fire occurred, portions of buildings fell, or debris fell upon and injured individuals);

and

(D) any area related to, or along, routes of debris removal, such as barges and Fresh Kills.'.

The Bottom Line - if you were a downtown Manhattan resident and you suffered injuries or illness related to the 9/11 crash or clean-up, you may be eligible for both health care benefits and a monetary award from the VCF as a result of the new Zadroga 9/11 Act.

9/11 Fire Department Hero Loses Battle with WTC Related Cancer

A FDNY hero who led his fellow firefighters out of the World Trade Center North Tower just before it collapsed, saving countless lives, has lost his battle with 9/11 related bone marrow cancer at age 51.  He had just recently received a bone marrow transplant after years of searching for a donor, and was hopeful that the procedure would lead to a recovery. 

Unfortunately, like so many 9/11 first responders who have contracted cancer (including multiple myeloma and other blood cancers) related to their service at Ground Zero, this particular cancer was too strong to beat in the end.  Please keep his family, and his fellow firefighters with similar conditions, in your prayers.

Who is Eligible for Zadroga Award under the Re-Opened Victims' Compensation Fund?

The newly re-opened 9/11 Victims Compensation Fund in the Zadroga 9/11 Act provides for a monetary award to a wide range of individuals involved in the rescue, clean-up, and repair efforts.  Individuals eligible for compensation may include: 

  • All first responders such as firefighters, police officers, and other municipal workers.
  • All construction workers.
  • All clean-up workers.
  • All sanitation workers.
  • All workers and volunteers who participated in the World Trade Center rescue and recovery efforts.
  • All workers and volunteers who participated in the removal of debris.
  • All workers and volunteers who participated in the clean-up of any damage from the September 11th attacks.
  • All workers and volunteers who participated in the remediation (demolition, construction, repairs, etc.) of any damage from the September 11th attacks.  

The Victim Compensation Fund may provide for monetary compensation to all workers and volunteers who were at the following locations, including: 

  • World Trade Center buildings and nearby structures.
  • Buildings and areas next to the World Trade Center.
  • Buildings and areas damaged as the result of the impact of the aircraft or any subsequent fire, explosions, or building collapses (including the immediate area in which the impact occurred, fire occurred, portions of buildings fell, or debris fell upon and injured individuals).
  • Any are along the route of debris removal including Fresh Kills
  • Any area the Special Master determines was sufficiently close to the site to cause harm
